ACLU Lawsuit Challenges Amendment One

The ACLU filed a lawsuit in 2012 on behalf of several couples with children challenging the ban on second parent adoption (the ability of the non-biological or non-adoptive parent in a same sex couple secure legal rights to be recognized by the state of NC as parent of their child). In light of the recent Supreme Court ruling on the Defense of Marriage Act (DOMA) the ACLU has requested to alter that lawsuit to more directly challenge Amendment One to the North Carolina Constitution. The outcome of this lawsuit will have tremendous impacts on parental rights and relationship recognition for same sex couples in North Carolina.
